It happens to everyone from time to time. You are driving down the highway or the street by your house, and you aren't paying attention to what you are doing. For whatever reason you creep up over the speed limit, and you aren't brought back to Earth until you hear the sirens and see the lights behind you. At that point you realize you are about to get popped for speeding.

Of all the tickets you receive out of all the possibilities, including red light cameras, failing to yield, failing to stop, even failing to use your turn signal, speeding seems to rub most people the wrong way. I think it is the fact that so many people speed every day that to get caught feels a little bit like you were the unlucky one and feels a little unfair.

So, after you get your speeding ticket you usually have some time to figure out what you want to do. Do you want to just pay the ticket and get it over with? Do you want to go to a mitigation hearing and ask the judge to lower the fine? Or do you want contest the ticket, to show the officer and the court that you weren't speeding, and potentially save money on the ticket and on your insurance premiums over the next couple of years? Often the last option is the most appealing, particularly since your fine isn't increased if you fight the ticket. The worst that can happen is what you are already facing, so why not fight your speeding ticket?

If you are like me when I have a problem I don't know how to answer, I start Googling. I'll Google things like "how to beat a speeding ticket," "secrets to beating a speeding ticket," and maybe even "speeding ticket lawyer" to see if there is any information out there that might be able to help.
If you google these things, you will find that there are a lot of websites out there that claim to know how to beat a speeding ticket and that claim to have extremely high success rates, but the truth is, there are no true loopholes or technicalities out there. Like any other legal case, criminal or otherwise, the only way to win is to discredit the other side, show they can't meet their burden of proof, or show that some required procedure wasn't followed. And that is exactly what speeding ticket attorneys do.

Assuming the technicalities don't work out (and if the case is a radar case you are fighting an uphill battle), the next best thing to look for are inconsistencies or a lack of evidence in the officer's report. Have you recently been issued a speeding ticket? If so you are not alone! It is a fact that every day motorist are issued over 115,000 speeding tickets. Almost every one of us at one time or another has tried getting out of a speeding ticket. Whether by trying to talk the officer out of a ticket there at the scene, or by going to court in hopes of getting your ticket dismissed. Ticket dismissal is not as common as it could be if people knew how to properly go about getting out of a speeding ticket. Use these following tips the next time you get pulled over and maybe you will be able to get out of your speeding ticket.
  • Be courteous and respectful to the officer. Act like a fool and you may find yourself in jail. If you disagree with the ticket, on the side of the road is no place to argue about it. That is what the court system is for.
  • Ask to see the radar. Make sure you do this politely!
  • After the officer has approached you, before he/she goes back to the squad car, ask if they can just give you a warning. If you do not ask and they go back to their car, most times you are going to get a ticket.
  • Take good notes immediately after leaving the scene. These notes may provide you with some idea of how to defend yourself later.
  • Try to set the court date out as far as possible. Try to reschedule if possible. In most cases, if the officer does not show, you automatically win your case. Try to make it difficult for the officer to attend.
  • When you do go to court, dress nice and professional. You also need to make sure that your attitude is in check.
  • If you see the officer before the court hearing, ask the officer again to dismiss the ticket. In some jurisdictions, the officer can waive the ticket up until the trial. They are people too, and maybe they were having a bad day that day.
If you use these tips for getting out of a speeding ticket the next time you get pulled over, you will greatly increase your chances of getting out of your speeding ticket.
It really stinks when you get a ticket. It is not the cost of the ticket that kills you, it is the points added on your driving record and the increased insurance cost that comes along with it. A $75 ticket can end up costing up to $1,000. Yikes!

Did you know that every day in America people are given traffic citations with out any proof to back up the citation. That is the beauty of the judicial system in this country, with out proof that you were speeding YOU CAN NOT BE CONVICTED. So, when you are given a speeding ticket you will need to know how to fight your speeding ticket. One of the most important thing to remember is to never argue with the officer who is issuing you the citation. It is important for you to always be courteous with the officer and make sure that at the same time you find out as much as you can about the offense you are given a ticket for. Getting a speeding ticket really sucks, but the great news is that learning how to beat speeding tickets in court is pretty easy. To beat that ticket, you just need to understand how the system works and then you will beat them at their own game. Once you see how, it can actually be fun questioning the officer on the stand and watching him fumble for answers. If you go into court without knowing what you are doing, you will almost certainly hear the words GUILTY as you are sent to pay your fine. Don't let that happen to you.
Here is a specific strategy used to win in court. This strategy assumes you have requested and received a copy of the officer's copy of your speeding ticket. This strategy falls under the Objection, Independent Recollection strategy. Here is how it works:
  • The officer will likely read from a copy of your speeding ticket with notes they took when they wrote your ticket. They take notes because they write 5 to 10 tickets daily and if goes to court, they can refer to the case. It's hard to remember detail from months ago for something done routinely.
  • During the court proceedings, the prosecutor will question the officer. The officer will likely read directly from the notes made on your speeding ticket. If this happens, immediately object. The officer is required to testify from "independent recollection" not from notes. The judge will likely over rule, allowing the officer to use the notes.
  • This is where you have them. This strategy sets the case up for dismissal on constitutional grounds and is a great strategy on how to beat speeding tickets in court.
The 6th Amendment in our constitution guarantees the right to be confronted by a witness. The officer is the witness, not the ticket or notes written on the ticket. If the officer has to read from the ticket to testify, he or she is not providing information based on their recollection as a witness. Without independent recollection, the officer is not considered competent to testify against you in the eye of the law. It is grounds for a Motion To Dismiss if the officer can't testify against you without the notes. In all likelihood, the case will be dismissed upon your Motion. If not, you have set the stage for an easy appeal of the decision should the judge rule against you. You will almost always win on appeal, so this is a key strategy in how to beat speeding tickets in court.
